These Terms & Conditions (“Terms”) govern your access to and use of the SnagPod LLC website, mobile applications, digital platforms, and related services, including SnagPod Wellness Safe Place and SnagPod Life Impact. By accessing or using any SnagPod service, you agree to these Terms. If you do not agree, do not use the applicable website, application, or service.
 

1. About SnagPod

SnagPod LLC (“SnagPod,” “we,” “our,” or “us”) develops technology solutions focused on prevention, wellness, accountability, education, and life-impact awareness. Our products and services may be made available directly to users or through participating schools, community organizations, prevention programs, support organizations, institutions, and other authorized partners.
 

2. Eligibility and Authorized Use

You may use SnagPod services only if you are authorized to do so. Access may depend on:
 

• age

• user role

• participating organization

• assigned program

• account status

• administrator approval

• parental or guardian authorization where required

• applicable law or organizational policy
   

You are responsible for ensuring that the information you provide is accurate and current.
 

3. User Accounts

Some SnagPod services require an account. You are responsible for:
 

• maintaining the confidentiality of your login credentials

• keeping your account information accurate

• using your account only for authorized purposes

• promptly reporting suspected unauthorized access
   

You may not share account credentials in a way that violates organizational policy or compromises system security. SnagPod may suspend or restrict access where necessary to protect users, organizations, system integrity, or security.
 

4. Educational and Informational Purpose

SnagPod applications are designed for educational, prevention, wellness, accountability, and program-support purposes. Information, scenarios, estimates, outcomes, prompts, and educational content are intended to support awareness and decision-making. They are not guaranteed predictions of actual outcomes. Individual results may vary based on factors including:
 

• jurisdiction

• institutional policy

• personal circumstances

• program requirements

• legal standards

• educational rules

• financial conditions

• other external factors
   

5. No Medical, Legal, or Emergency Advice

SnagPod services do not replace professional medical, mental-health, legal, financial, or emergency services. SnagPod does not provide:
 

• medical diagnosis

• medical treatment

• legal advice

• legal representation

• emergency response

• crisis-response services

• financial advice
   

If you are experiencing an emergency or immediate safety concern, contact 911 or the appropriate local emergency service.
 

6. Wellness and Support Features

SnagPod Wellness Safe Place may include features related to wellness check-ins, support, journaling, safety resources, case-management functions, or location-enabled tools. These features are intended to support communication, awareness, and program participation. They are not intended to replace licensed healthcare providers, emergency professionals, or other qualified service providers.
 

7. Life Impact and Scenario-Based Learning

SnagPod Life Impact may present interactive scenarios involving choices and potential consequences. These scenarios are educational and illustrative. Potential consequences may vary depending on jurisdiction, individual circumstances, policy, law, or other factors. Users should not rely on scenario content as a substitute for professional legal, financial, medical, or other specialized advice.
 

8. Organizational Access

Some users access SnagPod through participating organizations. Authorized administrators, case managers, program staff, educators, or other approved personnel may have access to certain information as necessary to:
 

• administer programs

• assign content

• review participation

• track progress

• provide support

• generate reports

• manage user access

• fulfill organizational responsibilities
   

Access is governed by assigned permissions and organizational settings.
 

9. Acceptable Use

You agree not to use SnagPod services to:
 

• violate any law or regulation

• impersonate another person

• provide false or misleading information

• interfere with system operation

• attempt unauthorized access

• bypass security controls

• upload malicious code

• misuse another user’s account

• harass or threaten others

• misuse support or safety features

• collect information about other users without authorization

• use the services for fraudulent or unlawful purposes
   

SnagPod may restrict or terminate access where misuse occurs.
 

10. Intellectual Property

Unless otherwise stated, SnagPod LLC owns or is authorized to use the intellectual property associated with its website, applications, software, content, branding, graphics, educational materials, scenarios, designs, trademarks, and related technology. This includes, where applicable:
 

• SnagPod

• SnagPod Wellness Safe Place

• SnagPod Life Impact

• DecisionShift™

• other SnagPod names, logos, marks, and proprietary materials
   

Users may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit SnagPod materials except where expressly authorized in writing.
 

11. User-Submitted Content

Certain features may allow users to enter or submit information, responses, notes, journal entries, or other content.

You retain any rights you may have in content you submit, subject to the permissions necessary for SnagPod to operate the applicable service.

By submitting content, you authorize SnagPod to process, store, and display that content as reasonably necessary to provide the service and support authorized program functions.
 

12. Privacy

Your use of SnagPod services is also subject to the SnagPod Privacy Policy. The Privacy Policy explains how personal information may be collected, used, stored, disclosed, and protected.
 

13. Third-Party Services

SnagPod may use third-party technology providers to support authentication, cloud infrastructure, hosting, security, analytics, mobile functionality, or other operational needs. Use of those services may also be subject to the terms and privacy practices of the third-party provider. SnagPod is not responsible for third-party services that are outside of its reasonable control.
 

14. Availability of Services

We work to provide reliable services, but we do not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable due to:
 

• maintenance

• system updates

• technical failures

• internet outages

• third-party service disruptions

• security events

• circumstances outside our control
   

Features may also vary by user role, program, organization, region, or subscription arrangement.
 

15. Account Suspension or Termination

SnagPod may suspend, restrict, or terminate access where reasonably necessary for:
 

• security

• misuse

• policy violations

• legal compliance

• organizational direction

• account inactivity

• program completion

• service discontinuation
   

Where appropriate, users may also be able to delete their own accounts through available in-app functionality.
 

16. Account Deletion

Where self-service account deletion is available, users may permanently delete eligible accounts through the applicable application.

Deletion may remove associated profile and participation information, subject to any data that must be retained for legal, contractual, security, or legitimate organizational purposes. Deleted accounts may not be recoverable.
 

17. Disclaimer of Warranties

To the extent permitted by law, SnagPod services are provided on an “as is” and “as available” basis. SnagPod does not guarantee that:
 

• services will always be available

• content will be error-free

• educational outcomes will be achieved

• specific consequences will occur

• the services will meet every user’s individual needs
   

Nothing in these Terms excludes rights that cannot lawfully be excluded.
 

18. Limitation of Liability

To the extent permitted by applicable law, SnagPod LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of the services. SnagPod is not responsible for decisions made solely based on educational or illustrative content provided within the applications. Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply in every circumstance.
 

19. Indemnification

To the extent permitted by law, users agree to be responsible for claims, losses, or damages resulting from their unlawful use, unauthorized use, or violation of these Terms. This provision does not apply where prohibited by law.
 

20. Changes to the Services

SnagPod may update, modify, suspend, add, or remove features from time to time. We may also update these Terms to reflect changes in our services, technology, legal obligations, or business practices. The updated Terms will be posted with a revised effective date.
 

21. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, except where applicable law requires otherwise. Any dispute involving these Terms will be handled in accordance with applicable law and any binding agreement governing the applicable service or organization.
 

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
 

23. Entire Agreement

These Terms, together with the Privacy Policy and any applicable program agreements, organizational agreements, or user consents, form the terms governing use of SnagPod services.
